Paladin Cards – Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Paladin Cards (“we,” “us,” or “our”) governing your access to and use of paladincards20.com (the “Site”) and all products, services, subscriptions, pre-orders, and transactions offered (collectively, the “Services”).

These Terms incorporate by reference our Refund & Sales Policy, Shipping Policy, Privacy Policy, Purchase Options & Cancellation Policy, and any other posted policies (collectively, “Store Policies”). All Store Policies form part of this binding agreement and shall be interpreted together as a single contract.

By accessing the Site, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms and Store Policies. If you do not agree, you must not use the Site.


1. Eligibility & Account Responsibility

1.1 Age Requirement

You must be at least 18 years of age to use this Site or make purchases.

1.2 Accuracy of Information

You represent that all information provided to us is accurate, current, and complete.

1.3 Account Responsibility

You are responsible for all activity occurring under your account.

1.4 Identity Verification

We may require identity verification for high-value or high-risk transactions.


2. Prohibited Conduct

You may not:

  • Use bots, scripts, automation tools, or circumvention software
  • Bypass purchase limits or allocation controls
  • Provide false identity or payment information
  • Initiate improper chargebacks
  • Engage in fraudulent, abusive, or harmful conduct

Violations may result in cancellation, permanent account restriction, IP bans, reporting to payment processors, and legal action.


3. Orders, Pricing & Allocation

3.1 Order Acceptance

All orders are subject to acceptance and availability.

3.2 Pricing & Promotions

Prices, limits, and promotions may change without notice.

3.3 Distributor Allocation

Products are subject to distributor allocation and manufacturer supply constraints.

3.4 Allocation Adjustments

Allocation reductions or shortages may result in partial fulfillment or cancellation without liability beyond amounts paid.

3.5 Order Cancellation Authority

We reserve the right to cancel orders due to pricing errors, fraud concerns, suspected policy violations, or supply limitations.

3.6 Order Cancellations & Account Restrictions

Repeated order cancellations, payment reversals, failure to complete payment, or disruptive purchasing behavior may result in temporary or permanent restriction of purchasing privileges.

Paladin Cards reserves the right to refuse future orders, suspend accounts, or permanently revoke ordering access at its sole discretion.


4. Pre-Orders & Structured Purchases

Pre-orders, subscriptions, deposits, and trial purchases are governed by our Purchase Options & Cancellation Policy. Release dates are estimates and subject to change. Market fluctuations do not qualify orders for cancellation.


5. Shipping & Risk of Loss

Shipping, delivery, and risk transfer are governed by our Shipping Policy. Risk of loss transfers to the customer once the shipment is accepted by the carrier, except where prohibited by law.


6. Package Forwarding & Third-Party Shipping Services

6.1 Assumption of Risk

Customers who utilize package forwarding companies, freight forwarders, mail forwarding services, reshippers, consolidation services, or any other third-party shipping providers do so entirely at their own risk.

6.2 Completion of Delivery Obligation

Paladin Cards fulfills its shipping obligations upon successful delivery to the shipping address provided by the customer at checkout. Once a shipment has been delivered to the designated address, any subsequent handling, storage, forwarding, consolidation, exportation, or international reshipment is outside the control of Paladin Cards.

6.3 No Liability After Forwarding

Paladin Cards shall not be liable for any loss, theft, damage, tampering, shortages, delays, customs issues, delivery failures, missing contents, or any other claims arising after delivery to a forwarding address or third-party shipping provider.

6.4 International Reshipment

Paladin Cards does not guarantee or support shipments that are subsequently forwarded outside the United States by third parties. Customers who choose to export, forward, or reship products internationally assume all risks associated with customs clearance, duties, taxes, transit delays, loss, theft, damage, shortages, tampering, and carrier errors.

6.5 Chain of Custody

Customers acknowledge that Paladin Cards cannot verify chain of custody after delivery to a forwarding location and therefore reserves the right to deny claims, replacements, refunds, chargebacks, insurance requests, or other remedies relating to packages that have been received, handled, or forwarded by third-party shipping providers.


7. All Sales Final

Due to the collectible and market-sensitive nature of trading card products, all sales are final except where required by law. Fees incurred for shipping, payment processing, and related services are non-refundable once incurred.


8. Product Condition Disclaimer

Products are sold manufacturer-sealed unless otherwise stated. Minor cosmetic packaging imperfections, shrink wrap tears, dents, scratches, seal irregularities, and printing inconsistencies are common in collectible products and are not grounds for refund, replacement, or compensation unless otherwise required by law.


9. Chargebacks & Liquidated Damages

9.1 Improper Disputes

Initiating a chargeback or payment dispute without first contacting Paladin Cards constitutes a material breach of this agreement.

9.2 Liquidated Damages

In the event of an improper chargeback, you agree to pay liquidated damages equal to the greater of $50.00 or 15% of the disputed transaction amount. This amount represents a reasonable pre-estimate of damages and is not a penalty.

9.3 Cost Recovery

You agree to reimburse Paladin Cards for chargeback fees, administrative costs, arbitration fees, attorneys’ fees, and collection expenses where permitted by law.

9.4 Collections

If unpaid for 30 days after written notice, balances may be referred to collections. You agree to pay lawful collection costs and interest.

9.5 Account Restriction

Accounts associated with improper disputes may be permanently restricted.


10. Pre-Dispute Resolution Requirement

Before initiating arbitration, court action, or chargeback, you agree to provide written notice to Paladin Cards and allow thirty (30) days to attempt informal resolution.


11. Arbitration & Class Action Waiver

Any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). Class actions and class arbitrations are prohibited. You waive the right to a jury trial. The prevailing party may recover arbitration fees and reasonable attorneys’ fees where permitted by law.


12. Evidence Presumption

Carrier delivery confirmation, signature confirmation, AVS match, CVV confirmation, fraud-screening results, payment authorization records, GPS delivery data, carrier photographs, and delivery scans shall constitute presumptive evidence of valid delivery and authorized transaction in any dispute.

Where a customer utilizes a package forwarding company, freight forwarder, mail forwarding service, reshipper, consolidation service, or other third-party shipping provider, proof of delivery to the forwarding address shall constitute conclusive evidence that Paladin Cards fulfilled its shipping and delivery obligations under the transaction.

Customer communications, order records, checkout information, tracking information, payment authorization data, fraud-screening records, and carrier records may be used as evidence in any dispute, chargeback, arbitration, or legal proceeding.


13. Limitation of Liability

To the fullest extent permitted by law, Paladin Cards shall not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost business opportunities, market fluctuations, loss of product value, or loss of collectible value.

Total liability shall not exceed the amount paid for the specific order giving rise to the claim.


14. Indemnification

You agree to indemnify, defend, and hold harmless Paladin Cards, its owners, employees, contractors, affiliates, payment processors, service providers, and partners from any claims, damages, liabilities, costs, fees, or expenses arising from your breach of these Terms, misuse of the Site, improper chargebacks, fraudulent activity, violation of Store Policies, or use of third-party forwarding or reshipping services.


15. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, allocation reductions, supply chain interruptions, distributor shortages, manufacturer delays, publisher release-date changes, payment processor holds, cyberattacks, carrier disruptions, labor disputes, government actions, platform outages, fraud-prevention holds, or operational limitations.


16. Severability

If any provision of these Terms is found unenforceable, invalid, or unlawful, the remaining provisions shall remain in full force and effect.


17. Entire Agreement

These Terms and Store Policies constitute the entire agreement between you and Paladin Cards and supersede all prior agreements, communications, representations, or understandings, whether written or oral.


18. Electronic Consent

Electronic acceptance of these Terms constitutes legally binding consent equivalent to a handwritten signature.


19. Governing Law

These Terms are governed by the laws of the State of Michigan. Venue for non-arbitrable disputes shall be Macomb County, Michigan.


20. Changes to Terms

We may update these Terms at any time. Continued use of the Site constitutes acceptance of revised Terms.
